MOVILIX WEBSITE USAGE TERMS AND CONDITIONS

Thank you for choosing to use Movilix Financial Services, LLC (“Movilix”) for your purchase of prepaid airtime for a prepaid mobile phone account. The following terms and conditions ("Terms") apply to your use of the Movilix Website and services. Please note that these Terms are addition to and separate from the services agreement of the prepaid mobile phone service provider for the account you are purchasing prepaid airtime for.

Identity and Use.

In order to use the Movilix services, you represent that you are:
  • at least eighteen (18) years old;
  • providing us with personal and payment device information that is true, accurate, current and complete;
  • the owner or authorized user of the payment device you have provided; and
  • are using the payment device to add funds to a valid prepaid mobile phone account and not for any unlawful purpose.

    • Use of Personal Information.

    During the recharge processes for the Movilix services, you will need to provide certain personal information, such as your name, telephone number and payment device number. You consent to sharing this personal information with us solely for us to provide you with the Movilix services and to comply with applicable law.

    Intellectual Property.

    The logos, trademarks, service marks, designs, text, images, graphics and other content of this Website are owned by Movilix and may not be copied, modified, imitated or used, in whole or in part, without the prior written consent of Movilix.

    No Refunds.

    There are no refunds for purchases using the Movilix services.

    Amendments.

    Movilix may modify these Terms at any time, and the modified version will be effective it is posted on this Website.

    Scope of the Movilix Services.

    The Movilix services are provided as a convenience to allow you to purchase prepaid airtime for your selected prepaid mobile phone account via the Internet. Movilix do not have control of and Movilix disclaim all liability for the use of your prepaid mobile phone account or products or services that are paid for via Movilix. Movilix reserve the right to refuse, limit or block your requests to add funds to a prepaid mobile phone account if Movilix deem necessary for lawful reasons, including security risks and suspected fraudulent activity.

    DISCLAIMER OF WARRANTIES AND LIABILITY.

    THERE ARE NO WARRANTIES WITH RESPECT TO THIS WEBSITE AND THE MOVILIX SERVICES. THE MOVILIX SERVICES AND WEBSITE ARE PROVIDED "AS- IS," "AS-AVAILABLE," AND AT YOUR OWN RISK, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. ALTHOUGH MOVILIX TRY TO MAINTAIN THE SECURITY OF SYSTEM, MOVILIX DO NOT GUARANTEE THAT THE MOVILIX SERVICES AND WEBSITE WILL BE ACCURATE, UPDATED, ERROR-FREE, CONTINUOUSLY AVAILABLE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. IF YOU CHOOSE TO ACCESS UNAFFILIATED WEBSITES WHICH ARE LINKED TO THIS WEBSITE, YOU DO SO ENTIRELY AT YOUR OWN RISK.

    MOVILIX SHALL NOT BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES ARISING OUT OF YOUR USE OF THE MOVILIX SERVICES OR WEBSITE.     SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES OR IMPLIED WARRANTIES AND THEREFORE THE DISCLAIMERS ABOVE MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

    Indemnification.

    You agree to indemnify us and our agents from all claims, liabilities, losses, expenses and damages, including attorney's fees arising out of your violation of these Terms, applicable law or your use of the Movilix services and Website.

    Regulation E Disclosures.

    Certain provisions in these Terms constitute disclosures under the Electronic Fund transfer Act and Federal Reserve Board Regulation E, 12 CFR Section 205.1 et seq.

    Taxes.

    You are responsible for any and all taxes which may apply to your use of this Movilix service, the receipt of funds on your prepaid mobile phone account, or use of your prepaid mobile phone account.

    Termination.

    Movilix may, at any time, suspend or terminate your use of the Movilix service for any reason alloMovilixd by law, such as if Movilix suspect possible fraud or suspicious activity, or for security reasons. Movilix may, at any time, suspend or terminate the Movilix service altogether.

    Severability.

    If any provision of these Terms is deemed unlawful, void or unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
